Terms and Conditions Overview -AllTrain Ltd

Pricing Includes 

  1. Onsite training and assessment, as outlined 

  2. Reporting of Unit Standards (Unit Standard 10851 (OSH Forklift) will only be registered on request and at an additional cost of $49) 

  3. Trainee certification (NZTA certificate or PDF copy, provided once invoicing is completed) 

Client Requirements 

  1. Advise AllTrain Ltd of any onsite Health and Safety induction needs, COVID requirements and emergency procedures prior to the start of training 

  2. Provide a suitable training room, air-conditioning/ heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/ white wall or TV (HDMI compatible) and tea/ coffee facilities for the duration of the course 

  3. Provide fit-for-purpose machinery and equipment. 

  4. Supply trainees with appropriate PPE for practical assessment 

  5. The practical assessment area must be isolated from and not impede any site operations 

  6. Prior to the start of training, provide to AllTrain Ltd any site/ company SOP’s, Safe Work Systems or Permit requirements 

  7. Trainees must be at least 15 years of age at the time of attending training 

  8. Trainees must provide a copy of a NZ Passport, NZ Drivers licence as proof of identification. 

As an AllTrain Ltd user, course registrant, and customer you agree to these Terms and Conditions. Terms and conditions and products are subject to change at any time during the terms of this agreement. Any such changes will be notified in writing. 

In these Terms and Conditions 

'Service', 'Services' means any service that is provided by AllTrain Limited including but not limited to training courses, assessments, or consultancy 

  • 'We' and 'Us' and 'Our' means AllTrain Limited 

  • 'You' and 'Your' means a customer 

  • 'Website' means the AllTrain Limited website at URL www.alltrain.co.nz 

  • 'Product' means any product or Service offered by AllTrain Limited 

  • 'Customer', ‘Customers’ includes any person buying or registering for a service from AllTrain Limited 

Changes to Terms and Conditions 

We reserve the right to update these Terms and Conditions from time to time, and if we do so, we will revise the date and revision number of this document. 

Cancellations/Rescheduling 

Cancellation or rescheduling of training courses and booked services must be made in writing to info@alltrain.co.nz. Cancellation fees are based on full course costs and will be incurred on the following basis: 

  • Where you have given notification to AllTrain Limited at least 10 working days prior to scheduled training or booking there is no cancellation or reschedule fee

  • Where you have given notification to AllTrain Limited within 4 - 9 working days prior to scheduled training or booking there is a 50% cancellation or reschedule fee

  • Where you have given notification to AllTrain Limited 3 working days or less in advance of scheduled training or booking there is a 100% cancellation/ reschedule fee

The Customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation and flights/ferry travel costs that may have been incurred. 

AllTrain Limited will not be liable for costs incurred by the Customer due to cancellation arising from circumstances beyond our control. 

From time to time we may need to reschedule a course or cancel a course due to trainer availability (sickness, bereavement etc), venue availability or low course attendance for example. 

Funded Courses

AllTrain Limited accepts no responsibility for the withdrawal of any funding or subsidies. In the event that funding/subsidies are withdrawn, or the Customer is found not to be eligible for the funding/subsidy, AllTrain Limited will invoice the Customer for the full course cost. 

AllTrain Limited will endeavour to deliver the course in the first instance with course cancellation a last resort. While we will do our very best to provide a minimum of 48 hours’ notice, from time to time the notice may be as little as 24 hours. We will arrange for an alternative time and date for attendance, and where you are not able to attend, a full refund or payment for the course is provided. 

Failure to attend training 

Failure to attend a course will result in a ’No Show’ attendance status. All ‘No Shows’ will be charged the full course cost. 

Late Student Arrival 

Within 60 minutes of scheduled start time: Student may remain on course only at the trainer’s discretion. Over 60 minutes of scheduled start time: Student may not attend the course. Should it be necessary for the student to return to complete the course at a later date due to late arrival issues, AllTrain Limited or any contracted trainer reserves the right to pass on any associated costs to the student or their employer. 

Course/Training Schedule 

The availability of courses and dates published on the Website are subject to change without notice. 

▪ AllTrain Limited reserve the right to cancel or alter the dates of any “Open” courses due to insufficient numbers of participants. 

▪ AllTrain Limited or our contracted Accessor’s reserve the right to suspend training where to continue might breach the Health and Safety at Work Act 2015, and its amendments, or where continuing might place participants at an unacceptable level of risk. 

▪ AllTrain Limited or our contracted Accessor’s reserve the right to refuse to train any person who is deemed unfit due to health reasons (including intoxication). 

▪ AllTrain Limited or our contracted Accessor reserve the right to refuse to train any company, employee or individual who we believe to be in competition with the services we provide. 

Company Specific Courses 

If training is held at the Customer’s premises the Customer agrees to provide all facilities including training room, air-conditioning/ heating, bathroom access, power outlets, tables, chairs, whiteboard, projector screen/ white wall, and tea/ coffee facilities. Facilities for specific courses are as detailed in the confirmation email and are according to the course requirements. 

Safety Gear and Personal Protective Equipment (“PPE”) 

In accordance with the HSWA 2015, all students are required to comply with any instruction, policy or procedure issued by AllTrain Limited in relation to the use of PPE. This includes, but is not limited to, the wearing of hard hats and safety footwear. Failure to comply may result in a student being removed from the course in the interest of safety. Should it be necessary for the student to return to complete the course at a later date, AllTrain Limited reserves the right to pass on any associated costs to the student or their employer. 

Entry Standards

There is a requirement that candidates must have a NCEA level 1, year 11, level of written and oral English or IELTS 5.5, to be eligible to enrol on the courses. Failure to comply with this requirement may result in the candidate being put at an unfair disadvantage. The person responsible for authorising attendance at the course must agree to and sign these terms and conditions of the course prior to acceptance of their candidate(s) onto the course. In the case where the candidate(s) do not meet the English language requirement, a reader writer must be supplied, by the candidate or the person responsible for authorising attendance. 

Special Requirements 

AllTrain Limited must be advised if the student has any special requirements including but not limited to health, literacy and cultural requirements.

Student Progress/Requirement for Completion 

Learning objectives are detailed at the beginning of each training module and assessment is conducted throughout the course. A practical assessment may also be conducted in some programmes. Candidates 

will be required to achieve the required level of competency in all areas of the assessment to be awarded the unit standard(s) and credits. Assessment is conducted in compliance with competency based assessment according to NZQA criteria. 

Pre-Course / Post-Course Requirements

The Customer accepts full responsibility for failure to abide by any pre-course or post-course requirements. This includes, but is not limited to, completing and returning course paperwork, evidence of competency, Logbooks, attestation forms. 

Attestation Forms

Where an Attestation Form is required, the participant will have two weeks from the date of the course to complete and return the form to AllTrain Limited. Failure to return a completed attestation form will prevent the unit standard being processed. This may result in any funding/subsidies being withdrawn and the participant will be invoiced the full non-funded course cost accordingly. 

NZQA Framework Registration

AllTrain Limited or it’s associated contractors may process as applicable NZQA unit standards through accredited Private Training Establishments (PTE’s) or Industry Training Organisations (ITO’s) who will upload credits to the NZQA Framework within 4 weeks following course completion based on awarded competency. Additional charges will apply per extra unit/ credit added at the time of booking. 

Competency

It is AllTrain Limited ’s or our contracted Accessor’s intention to mark a course participant as Competent “C” or Not Yet Competent “NYC” upon completion of the course. A participant who is marked as C will receive their Certificate (if requested) within four weeks of completing the course. A candidate who is 

marked as NYC cannot have the unit standard accredited to them and will not receive any certification. The Customer will be advised if a candidate is marked NYC and the reason why. A plan will be developed 

with the Customer to ensure that the Candidate has all opportunities afforded to achieve competency status. 

Payment Terms 

Recoverable Collection Costs: 

Any non- payment or default on payment, customers are liable to pay any costs associated with collecting payment and Debt Collection. 

Public attendees: 

Once you have returned your booking form an invoice will be raised, then Payment can be made using the invoice number as the reference. Payment must be received by AllTrain Limited prior to attending the course unless you have an agreed arrangement. Once payment has been received, we will send you confirmation by email. 

Note: All individual clients must pay in full before the course commencement date. 

Non account holders: 

Are required to pay invoices within 7 days of the date of invoice. 

On Account: 

If you have an account with us... 

  • The Customer agrees to make full payment by the 20th of the following month in which an invoice is raised. 

  • The Customer agrees to pay interest at the rate of 5% per month on all overdue amounts. 

  • If the Customer fails at any time to pay any invoice by the due date AllTrain Limited may immediately suspend the Customer’s account and cease to supply training to the Customer. 

  • All costs incurred in the collection of the unpaid debts through a collection agency will be charged to the Customer. 

Prices and Additional Fees 

The prices published on the Website are subject to change without notice unless you have an agreement with us stating otherwise. Issuing Replacement ‘Certificates of Attendance or Achievement’ will incur an administration fee of $25.00 Excl GST each and requires payment before the request can be completed. The Customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation when local resource is unavailable. These charges will be charged at cost to the Customer and will be advised during the booking process. 

Cancellation

The Customer agrees to pay any additional costs incurred by AllTrain Limited, such as travel and accommodation and flights/ferry travel costs that may have been incurred. 

AllTrain Limited will not be liable for costs incurred by the Customer due to cancellation arising from circumstances beyond our control. 

Communication 

You may occasionally receive e-newsletters and promotional emails from AllTrain Limited once the booking form has been returned. You can unsubscribe by following a link in any of the emails you receive. AllTrain Limited will not pass your email on to any 3rd party unless required to do so by law.
